Steve Nash Returns, Lakers Rally Past Warriors In OT (VIDEO)

OAKLAND, Calif. -- Kobe Bryant had 34 points and 10 rebounds, Steve Nash finished with 12 points and nine assists in his first game in almost two months, and the Los Angeles Lakers rallied from 14 points down in the fourth quarter to beat the Golden State Warriors 118-115 in overtime on Saturday night.

Metta World Peace and Nash each made a go-ahead 3-pointer in the final minutes of regulation before the Warriors came back. World Peace scored 20 points, and Nash converted a step-back shot for the final points in overtime to lift Los Angeles to its fourth straight victory.

Jarrett Jack scored 29 points and David Lee had 20 points and 11 rebounds in a disappointing collapse for Golden State, which had won 11 of 14 games to get off to its best start in 20 years. As so often has happened in this one-sided California rivalry, the Lakers took over when it mattered most.

The 38-year-old Nash missed the previous 24 games because of a small fracture in his lower left leg. He was injured in the second game of the season, the former Phoenix star's first with the Lakers.

Los Angeles' rejuvenated point guard showed no signs of rust in the crucial moments.

Nash's 3-pointer gave the Lakers a 103-102 lead with a little less than 2 minutes left in regulation. Festus Ezeli answered with an alley-oop from Jack to put the Warriors back ahead, only to watch Bryant swish a pull-up jumper from 20 feet on the other end.

After Lee's jumper gave Golden State the lead again, World Peace made a corner 3 to put Los Angeles ahead 108-106 with 24.1 seconds remaining. Jack followed with a tying, step-back shot, and the Lakers took over with 14.9 seconds left before Bryant missed a jumper over two defenders at the buzzer.

Bryant made three quick jumpers in overtime, including a fadeaway that left him pumping his fist near the Warriors bench, to put Los Angeles ahead by four. He has scored at least 30 points in eight straight games.

After Curry's 3-pointer trimmed the Lakers' lead to one, Nash's step-back shot in the paint over Curry extended Los Angeles' cushion again. Curry missed a potential tying 3-pointer before Los Angeles grabbed the rebound ? and the game.

The Lakers had handed Golden State its most lopsided-loss of the season on Nov. 9, a 101-77 rout in Los Angeles. In the past two months, the Lakers had continued to slide while the Warriors had become surprising winners.

The matchup Saturday marked the first time the Warriors faced the Lakers with a better record through at least 25 games since April 23, 1994.

Lakers coach Mike D'Antoni said before the game that Nash's return could be a fresh start for the franchise, especially with more difficult matchups looming, including a showdown against the New York Knicks (19-7) on Christmas. He said the lineup with Nash is what he had envisioned when the Lakers called him in November to replace Mike Brown, who was fired after a 1-4 start to his second season.

With Nash anchoring D'Antoni's fast-paced system, the Lakers still had no problem settling in offensively.

They scored 15 points off 10 turnovers in the opening quarter to take a 31-27 lead. Dwight Howard was in foul trouble throughout, and the center's absence hurt Los Angeles on the other end, with the Warriors moving in and around the paint almost unchallenged.

At one point, Jack juked Nash and every other defender Los Angeles threw his way. He scored 15 points in the second quarter, sparking a 14-0 run that helped put Golden State ahead 61-53 at halftime.

The up-and-down pace had everybody winded. Curry had to ask coach Mark Jackson to come out for a moment in the third quarter as Golden State played its fourth game in five nights. After a brief rest, Curry keyed another surge to give the Warriors an 88-74 lead early in the fourth quarter.

Bryant practically willed the Lakers back by himself as he has done so often in his illustrious career. He finished an alley-oop from Nash on the next play with two hands, sliced Golden State's lead to 90-88 when he dunked after a give-and-go bounce pass from Howard midway through the fourth, and tied the game at 95 with a 3-pointer in the face of Harrison Barnes minutes later to set up the frantic finish.

NOTES: Darius Morris started at shooting guard for the Lakers ahead of World Peace. D'Antoni said he likes World Peace's energy off the bench, but he will still make some starts depending on the matchup. ... The Lakers have swept the Warriors in three of the last four seasons, including all four during the 2011-12 campaign. They have two more games against each other this season. ... Carl Landry's put-back layup at the halftime buzzer was waved off after officials reviewed television replays.

Five Success Tips for Step-Families

Step-families are not a new phenomenon, but they are getting more common these days. And there is no doubt that step-families present some challenges. While there are no perfect formulas or guarantees for success, there are some things you can do to up your chances at success. Here are five success tips for step-families.

1. Be Patient

If your new spouse or partner doesn?t immediately love your kids like they love their own, don?t despair. It?s pretty hard to love someone instantly! Building loving relationships takes time. Your partner doesn?t have the history with your kids that you do. And if you?re on the other end of things ? trying to build a relationship with your step-children ? then you?ll also need some patience. They just may not respond right away ? love isn?t like a light-switch.

2. Be Realistic

All step-families can?t be the Brady Bunch. It pays to be realistic about the step-family relationships. Holding on to a fantasy about how it?s supposed to be can lock you into a critical mindset, or keep you from appreciating what you do have because you have unrealistic expectations. The reality is, experts remind us, that your step-children may not respond the way you hoped or imagined they will (or think they should).

3. Respect Biological Relationships

Whether you like the biological parent of your step-kids isn?t really the point. The fact is, the biological parent is loved by your step-kids, and unless he or she is abusive or dangerous, it?s good to respect and foster that relationship between your step-kids and their biological parents.

4. Discuss Parenting Styles

Before you get married or move in together as step-parents, make sure you agree on parenting style. This may involve compromise on your part or your partner?s, but it?s important to present a united front. Otherwise, your step-kids (and biological kids) may get confused, and learn to pit one of you against the other.

5. Try to Keep It Equal

This can be tricky, especially when the biological parent ?spoils? your step-kids and you don?t do the same for your kids. What can you do if your step-daughter comes home after visiting with her mom, and she?s carrying all kinds of new toys? What about your son getting that trip to an amusement park while he visits with his dad?

While you can?t control what happens during visitation, you can set rules in your own home. You might try setting a rule that toys and gifts stay at the home of the giver. And in your own home, you can make sure that all your kids ? biological and step ? are subject to the same rules and privileges.

The folks over at Dijit have been busy as the year draws to an end, issuing updates for both their universal remote app and NextGuide tablet app that promises to help us escape traditional grids. The newest version of the Dijit remote (a free app that brings control features when paired with Griffin's Beacon) is now integrated with NextGuide, allowing users to share profiles across the software, the welcome addition of a "record to DVR" button for DirecTV subscribers, a refreshed UI, accessibility enhancements and finally support for iThing screens of various shapes, sizes and resolutions. After defiant stance, NRA prepares for battles

National Rifle Association executive vice president Wayne LaPierre faces new scrutiny Sunday when he appears on NBC?s Meet the Press, following the strong reaction over his defiant stand during a Friday press briefing about the NRA?s response to the Dec. 14 school shootings in Newtown, Conn.

Amid a national debate over what security measures school administrators should take to ensure the safety of students, gun-control advocates reacted with disbelief Friday to LaPierre?s call for armed guards in every school and his blaming of Hollywood, video games, music, the courts, and more for school shootings such as the one in Connecticut.

In an impassioned statement in Washington Friday, LaPierre ridiculed the idea that ?one more gun ban or one more law imposed on peaceful, lawful people will protect us where 20,000 other laws have failed.?

LaPierre said America has left its schoolchildren ?utterly defenseless -- and the monsters and the predators of the world know it and exploit it.?

Sen. Frank R. Lautenberg, D-N.J.,? who has proposed legislation to ban ammunition magazines that have a capacity of more than 10 rounds, said after LaPierre?s Friday statement that "it is beyond belief that following the Newtown tragedy, the National Rifle Association's leaders want to fill our communities with guns and arm more Americans."

The NRA is confronting its greatest legislative test in 20 years in the aftermath of the Connecticut shootings, as President Barack Obama and some members of Congress are moving to enact further measures to restrict gun sales and possession, most likely as part of a larger bill that would include increased funding for mental illness detection and treatment.

After a week of silence following the massacre at Sandy Hook Elementary School the NRA responded, saying armed guns in schools is the answer. "The only thing that stops a bad guy with a gun is a good guy with a gun," said Wayne LaPierre, NRA's executive vice president. NBC's John Harwood reports.

Obama has tasked Vice President Joe Biden with the job of consulting with members of the Cabinet and outside organizations to come up with legislative proposals by next month.

In a statement on the NRA?s Institute for Legislative Affairs website Friday, the group told its four million members that ?if you think the latest gun control debate will be limited solely to legislation to ban semi-autos and ?large capacity? magazines, think again. Calls have already been renewed to subject all private sales of firearms to background checks, even among family members and friends, and to end mail-order sales of ammunition.?

The statement added, ?We knew that this fight was coming.? But it's now crystal clear that this latest round is on an expedited track and the corresponding rhetoric has been amped up exponentially.? The group urged its members and ?the tens of millions of other law-abiding American gun owners? to contact members of Congress ?and let them know that gun bans and other restrictions on our Second Amendment rights are not the solution.?

Sen. Dianne Feinstein, D-Calif., the author of the 1994 ban on certain types of semiautomatic firearms which expired in 2004, has announced that she will introduce new legislation early next year. Semiautomatic firearms, including semiautomatic weapons sometimes called ?assault weapons,? fire one round per pull of the trigger.

Her bill would outlaw more than 100 specifically-named firearms as well as certain semiautomatic rifles, handguns and shotguns that can accept a detachable magazine and semiautomatic rifles and handguns with a fixed magazine that can accept more than 10 rounds.

How firmly the NRA?s allies in Congress will oppose any new legislative initiatives from Obama, Feinstein or others remains an open question.

After a week of calls for tighter gun restrictions, the National Rifle Association called for putting more armed security officers in the nation's schools and expressed concerns about violence portrayed in video games, movies and music. NBC's Pete Williams reports.

According to the Center for Responsive Politics, the NRA spent $18.8 million in the 2012 campaign on independent political spending and another $1 million on direct contributions to candidates.

The NRA suffered some significant defeats, as its efforts to defeat Obama and Democrats such as Sen. Sherrod Brown, D- Ohio, Sen. Bill Nelson, D ?Fla., and Virginia Senate candidate Tim Kaine fell short.

In a test of the NRA?s legislative influence, the House of Representatives late last year passed the National Right-to-Carry Reciprocity Act, which has not yet been acted on by the Senate.

In the House vote, 229 Republicans and 43 Democrats voted for the NRA-backed bill.

The House bill allows a person with a photo identification card and a valid permit to carry a concealed firearm in one state to carry a concealed handgun in another state in accordance with the restrictions of that second state.

Senate Democrats who have worked with the NRA in the past and who are up for re-election in 2014, such as Sen. Mark Begich of Alaska, will be pivotal in the outcome of any legislative battle in the Senate.

?I get that some want to talk about (regulating guns), but we have a broader issue and we live in a violent society and we need to look at mental health and how to make our schools safer,? Begich said Friday?in an interview with the Fairbank Daily News-Miner.

Under pressure from its international lenders to do something about tax cheats, the Greek government announced a major shakeup of its tax offices, with 164 directors, deputy directors and Finance Ministry observers being moved to different departments as part of efforts to improve tax collection.

Some of the directors will retain their positions but be moved to different departments, while others will be demoted. Twenty new officials will be hired to take up positions at the Financial Crimes Squad (SDOE) and other bodies that carry out inspections. Among those being moved is SDOE?s head of operational planning, Nikos Lekkas, sources said.

The newspaper Kathimerini reported that some of the staff who will be affected by the move have threatened to take legal action against the ministry and claim that an evaluation process has to be completed before the government can change their positions.

With only days to go in the calendar year, the Finance Ministry had decided to require taxpayers to submit receipts with their tax returns next year or face a tax surcharge, which means people who weren?t collecting receipts all this year face another big hit. Greeks will have to collect receipts worth 25 percent of their gross income.

If they fail to do so, they will face a further tax of 22 percent on the difference between what they collect and the target set by the Finance Ministry. For example, someone earning 30,000 euros a year will have to gather 7,500 euros in receipts. If they gather 5,000 euros, they will be taxed 22 percent of 2,500, which is 550 euros.

The Finance Ministry also got a favorable ruling from the Supreme Court which ruled that an emergency property tax introduced in 2011 could still be levied via electricity bills. Judges accepted the government?s appeal against a first instance court ruling that the Public Power Corporation could not collect the tax, following complaints by consumer groups.

The government said the tax is vital to the government?s revenue targets and having to collect it via another method would have disrupted its fiscal efforts, although critics said some big businesses are paying a much lower rate or have been exempted.

Finance Minister Yiannis Stournaras directed the utility to ignore it and keep collecting the money. The tax was first imposed as a one-time emergency measure last year when current PASOK Socialist leader Evangelos Venizelos was finance minister but now seems to be permanent, along with a doubling of income taxes and taxes on the poor.

'Heart resilience' biomarker may help predict chemotherapy-induced cardiac damage earlier

Dec. 21, 2012 ? By using a blend of high definition cardiac imaging and biomarkers, Ohio State University cancer and heart researchers think they may have a way to catch early heart damage caused by anthracyclines, a class of chemotherapy drugs commonly used to treat breast and childhood cancers.

Presented at the recent San Antonio Breast Cancer Symposium, and funded by the Ohio State Center for Clinical and Translational Science (CCTS), the study looked at breast cancer patients being treated with doxorubicin, a type of anthracycline that is effective at treating breast cancer, but may lead to future heart problems in some women long after the treatment is complete.

"Currently, we are unable to predict who is more likely to develop heart problems, and we usually only catch the damage once it's too late." said Dr. Maryam Lustberg, a breast oncologist at the Ohio State University Comprehensive Cancer Center -- Arthur G. James Cancer Hospital and Richard J. Solove Research Institute (OSUCCC-James). "If we could identify these at-risk patients earlier, we could introduce cardio-protective drugs or eliminate cardio-toxic drugs."

The study honed in on measuring epithelial progenitor cells (EPCs) -- a rare cell type found in the bloodstream that can indicate cardiac reserve, a measure of how resilient the heart can be in recovering from various insults. EPC levels are a well-established predictor of outcomes in patients with heart attacks or heart disease, but the researchers are the first to explore their use in predicting which chemotherapy patients may be at highest risk for developing cardiac injury after exposure to anthrcyclines.

In addition to looking at EPCs, researchers analyzed heart function and physical changes to the heart using cardiac magnetic resonance imaging (CMR), as well as measuring blood levels of troponin and BNP, two biomarkers that indicate cardiac damage. Measurements were taken before, during and after the course of treatment, which for breast cancer patients, typically lasts about two months.

Researchers found that patients who came in with lower EPCs were more likely to have higher levels of troponin in their blood by the end of treatment. While the treatment was well-tolerated, and there were no acute indications of damage to heart function, the researchers also identified a trend in physical changes in the heart, including increased water content in heart cells and indications that the heart was working less efficiently.

Dr. Subha Raman a cardiologist and professor of cardiovascular medicine at Ohio State's Wexner Medical Center noted, "By pairing CMR with measuring the amount of chemical messengers in the blood stream, we're building a solid foundation that may help us develop a predictive model in the future."

The researchers plan to reassess patients at 12 and 24 months, and hope to follow the study group for as long as five years in order to capture more data.

"This kind of research is a testament to the fact that survival rates after a cancer diagnosis have never been higher. We want to make sure that life after cancer treatment is as healthy as possible," said Lustberg.

There's a new report out today from informa, and it's about Android adoption rate and market share in China. We all know that Android has the lions share of the Chinese market, but now we have a bunch of numbers to tell us just how many phones we're talking about.

It's figured that 33-percent of all Android devices sold in 2012 were bought in China. This number is a bit skewed, and we'll get to that in a bit, but this is much higher that the 11-percent that were sold in the US -- Android's second largest market. I'm curious how the numbers look if dealing with the EU as one entity, but that's neither here nor there.

We saw the 33-percent of all Android devices sold in 2012 we in China, but -- and this is a big but -- only 59-percent of those were using an "authentic" build of Android and use Google's services. That means that a full 41-percent of the zillions of Android phones sold in China aren't getting counted in activation numbers or that monthly OS chart we see from Google. They are phones running customized version, from the likes of Baidu or Alibaba. Let's get out our wizard hats and do a little math. 

  • There are approximately 1.5 million Android devices activated every single day.
  • A full third of that would be 500,000 phones and tablets.
  • 59-percent of that total would be 295,000.

So if 295,000 of the 1.5 million  phones activated daily (rounded up for easy math) are sold in China, that means that 20-percent (19.666-percent) of all the numbers you see getting thrown around come from one country. And that is a whole lot of smartphones.

Interesting aside -- it also means that a full 13-percent of all "android devices" sold in China aren't even counted as Android activations by Google. 

These numbers are likely to grow, says Malik Saadi of informa. 

Looking forward, Android is expected to continue gaining market share globally and, by 2015, one in every two handsets sold worldwide will be powered by it. New York Bans Another 2,000 Sex Offenders from Online GamingNew York State, whose "Operation Game Over" earlier this year banned more than 3,500 registered sex offenders from services like Xbox Live and the PlayStation Network, has booted another 2,100 from online gaming after bringing THQ, Funcom and NCSoft to the cause.

Eric T. Schneiderman, the state's attorney general, announced the bannings earlier this morning. They coincide with state law requiring convicted sex offenders to register all email addresses, screen names and other online personae with the state. The state then turns that information over to its Operation Game Over partners, who purge the convicted sex offenders from their rolls.

Many states have sex offender registries, with requirements covering email addresses and the like, but New York State says it is the only one working to have offenders removed from online gaming services. The initiative was inspired by this case, in which a 19-year-old met a 12-year-old boy over Xbox Live, arranged a meeting with the child, and then sexually abused him. The offender was sentenced earlier this year to six months in jail, making his lifetime permaban from online gaming a more lasting and potentially worse punishment.

In addition to THQ, NCSoft, Funcom, Microsoft and Sony, publishers such as Gaia Online, Apple, Blizzard Entertainment, Electronic Arts, Disney Interactive Media Group and Warner Brothers are working with the state.

In such circumstances, Auctioneer recommends that buyer contact the software manufacturer directly to resolve any such issues.?

6.???????? Auctioneer relies on information about assets in the auction provided by the seller.? Auctioneer undertakes no investigation of that information, and makes no representation or warranty concerning the truth or completeness of that information.? Photographs are provided solely for the buyers' convenience and shall not be construed to create representations or warranties of any kind pertaining to the assets.? Buyer acknowledges that it has had the opportunity to inspect all assets prior to tendering its bid and waives any and all claims against Auctioneer and/or seller relating to asset photographs or descriptions.

A discounted buyer's premium of 16% of the bid price will be added to the purchase price for each lot for buyers who pay in the form of cash, cashier's check, company check (with a letter of guarantee) or wire transfer within 72 hours from receipt of Auctioneer?s invoice; the full buyer's premium of 18% shall apply for buyers who pay via credit card and all other buyers that do not remit payment within 72 hours from receipt of Auctioneer?s invoice.

8.???????? Collection of applicable taxes will be in accordance with the laws of the jurisdiction in which the purchased asset is located.

9.???????? Each successful buyer must pay a 25% deposit toward the purchase price immediately following the successful bid.? Buyers expressly authorize Auctioneer to use their credit card to satisfy the deposit amount.? If a buyer fails to make a timely deposit, Auctioneer and the seller may resell the items in question without notice.? Full payment of the purchase price is due at the earlier of (i) 48 hours after the buyer has received an invoice, or (ii) the close of business on the third business day after the auction but in any event by the Payment Date set out in the Notice to Purchasers.? Without limiting the foregoing, full payment of the balance of the purchase price is due prior to removal of any purchased assets.? In the event that a buyer fails to pay the entire purchase price (in addition to the buyer?s premium and any applicable tax) within the time specified by Auctioneer or otherwise fails to comply with these Terms and Conditions, Auctioneer and the seller will retain the deposit as liquidated damages without notice.? Auctioneer accepts the following methods of payment: cash, cashier?s check, and wire transfer made payable to Auctioneer also will accept a company check if it is accompanied by a letter from the company?s bank guaranteeing payment in full, without condition and upon demand. Auctioneer will also accept VISA?, MasterCard?, American Express? if so indicated in the Notice to Purchasers.

By participating in an auction, each buyer represents, warrants and covenants that (i) it shall not misrepresent its ability to close the transaction pursuant to the terms and conditions of sale, (ii) it has the capacity to close the transaction, (iii) it has actual authority to enter a bid, and to enter into an agreement to purchase the item, and (iv) any bid it makes on an item constitutes an irrevocable offer to buy the item for the full amount of the bid.

12.??????? Auctioneer may, in its discretion, offer the assets for sale by the piece or by the lot.? In addition, Auctioneer may augment an auction with assets from various sellers.? These assets may be interspersed throughout the auction.? The seller has the right to remove assets from the auction either before or after bidding has completed.? In the event of a removal after bidding has been completed, the purchaser?s sole remedy shall be the refund of any purchase price actually paid.

13.??????? Auctioneer will announce any additions to or deletions from the catalog on the day of the auction.? Auctioneer and the seller assume no responsibility for, and make no representations or warranties concerning, descriptions of assets contained in marketing materials for the auction.? It is the buyers? obligation to verify such descriptions prior to the auction.

14.??????? Neither seller nor GoIndustry DoveBid shall be liable, in contract, tort (including negligence) or for breach of statutory duty or in any other way for:

??????????? (a)??????? any loss arising from or in connection with loss of revenue, profits, contracts or business or failure to realize anticipated savings or profits;

????? (b)??? ??? any loss of goodwill or reputation; or

??????????? (c)?? ???? any indirect or consequential losses suffered or incurred by Buyer,

arising out of or in connection with these Terms and Conditions and any of the actions or events contemplated within them or deriving from a sale of goods pursuant to them (?Relevant Events?).

The aggregate respective liability of Seller or GoIndustry DoveBid in respect of any other loss or damage suffered by a Buyer and arising out of or in connection with these Terms and Conditions or arising out of or in any way connected with any Relevant Events, whether in contract, tort (including negligence) or for breach of statutory duty or in any other way, shall not exceed (i) in the case of the Seller, the amount of the purchase price paid by the Buyer; and (ii) in the case of GoIndustry DoveBid the buyer?s premium paid by the Buyer, in each case in respect of the goods which are the subject of the claim.?

The Buyer undertakes to defend (by counsel satisfactory to GoIndustry DoveBid) and indemnify GoIndustry DoveBid and Seller and hold GoIndustry DoveBid and Seller harmless from and against any claim, demand, cause of action, liability or expense (including attorneys' fees and costs) asserted against or incurred by GoIndustry DoveBid, the Seller or any third party in connection with the sale, removal, shipment or use of any purchased assets or a breach by the Buyer of these Terms and Conditions.?

15.??????? Auctioneer will announce the removal, or "check-out" in the Notice to Purchasers. Auctioneer shall have no responsibility to disconnect utilities to the sold asset, including electric, gas, waste and water lines. It is the buyer's sole responsibility to arrange and pay for the removal,? shipment and insurance of purchased items. Also, it is the buyer's responsibility to provide, and/or ensure their agent(s) performing removals on their behalf provide, upon demand, evidence of valid insurance policies with reliable insurance companies, providing the types of coverage and in the amounts more particularly described in the Sample Required Insurance Certificate located in the Shipping Information section of Auctioneer?s website and such other insurance as may be required by any governmental authority, including workers' compensation insurance. Removal shall be conducted responsibly and with due care for the seller's premises. Auctioneer reserves the right on any sale to require that all buyers utilize the services of the movers/shippers/riggers to those listed on Auctioneer?s website under ?Directory of Shippers? and/or those listed on the sale website as ?exclusive, approved? for a particular auction.? The buyer shall restore and repair all real and personal property that is altered or damaged as a result of the removal of purchased items. If the buyer does not remove an item within the announced check-out period, Auctioneer and the seller may, in their sole discretion, deem the item to have been abandoned by the buyer and the buyer will have no further rights with respect to the item. Notwithstanding the foregoing, Auctioneer and the seller reserve the right to charge the buyer for the costs of storage beyond the check-out period.

16.??????? Buyers acknowledge that an auction site or the seller?s site is a potentially dangerous place.? Flammable, noxious, corrosive and pressurized substances may be present.? Heavy equipment may be operated, and electrical circuits may be live.? Every person enters such site at his or her own risk with notice of the condition of the premises and the activities that will be or have been conducted on the premises.? Buyers shall so advise their agents and employees.? No person shall have any claim against Auctioneer, the seller or their respective agents or employees for any injuries sustained or for damages to or loss of property that may occur at such site.

17.??????? International Statutory Compliance Exclusion.?? It is expressly brought to the Buyer's attention that, at the time of sale, any asset for sale in this sale:

(a)??????? may not necessarily comply with the Health and Safety at Work Etc. Act 1974, Environmental Protection Act 1990 or any other UK and/or EC Acts, Regulations, Directives or their applicable laws or equivalent or similar laws in any relevant jurisdiction or; and

(b)??????? could contain blue or white asbestos, hazardous substances, dangerous chemicals etc. which if not handled correctly during their removal from a site could be in breach of the Health & Safety at Work Etc. Act 1974, Control of Substances Hazardous to Health Regulations 2002 or any other current legislations covering the use of such substances in a working environment in the UK, the EC, the United States or any other relevant jurisdiction.? GoIndustry DoveBid has no duty to remove any hazardous substances that are contained in or are a part of any asset.??

The Buyer undertakes to (i) remove, ship and use any purchased plant and equipment within any relevant jurisdiction in a way that does not contravene any relevant legislation and in full compliance with all applicable health and safety standards and regulations; and (ii) comply with all current applicable legislations in any relevant jurisdiction and reasonable instructions by GoIndustry DoveBid in relation to the removal/disposal of waste including hazardous waste.

18.??????? The Buyer agrees to comply with all applicable export control and related laws and regulation and not to violate any applicable local, state, national or international law, statute, ordinance, rule or regulation.? Buyers acknowledge that GoIndustry DoveBid is not the exporter of any purchased asset unless expressly stated. GoIndustry DoveBid makes no representation or warranty concerning, and has conducted no investigation to ascertain which assets, if any, constitute, for example, ?Restricted Technology? for US law purposes or whose export is otherwise restricted under applicable law. GoIndustry DoveBid and/or the Seller reserves the right to cancel or rescind any sale at any time in the event it determines, in its absolute discretion, that the sale does or may violate applicable export or import control or related laws and regulations.?

19.??????? These Terms and Conditions, and all questions with respect to the interpretation of these Terms and Conditions, shall be governed by and construed in accordance with the internal laws of the State of Maryland, without regard to conflict of laws provisions.? All buyers expressly consent to personal and exclusive jurisdiction in the courts of the State of Maryland located in Baltimore.

The Meebo Bar returns, this time with more Google

Back in the balmy heat of June Google snapped up (and then largely dismantled) a new property by the name of Meebo. Now, as winter starts to bite, it looks like the one part it was going to keep -- the tool bar -- is back in full Google livery. The discovery comes after a few eagle-eyed users noticed it on TV Guide. The bar itself seems pretty unobtrusive right now, with just some site specific menus on the left hand side, with the expected Google+ sharing options on the right.
